Belgium dependant visa

Here is a brief documentation of the process and the required documents in case you have a dependant to travel with you (assuming you are on work permit).

First of all, please note that the documents required may slightly vary depending on the firm for which you work.

Documents required1. Your’s and your dependant’s Police clearance certificate issued by the Passport Office in India.
2.Your’s and your dependant’s medical certificate issued by a Government Hospital recognized by the Consulate General of Belgium.
3. Your marriage certificate in case you are taking your Wife/Husband.
4. Your’s and your dependant’s certificate of birth issued by the City Corporation or Muncipal Office or Taluk office.

Where do you get these documents?Documents listed in point 1 and 3 are mandatory documents whereas documents mentioned in point 4 may not be asked if you are processing your dependant’s visa outside your company by yourself.

The police clearance certificate should be obtained from the Regional passport office in your state (nearest city or state capital would have a passport office).
The medical certificate will be issued by a Government Hospital recognized by the Consulate General of Belgium. The list of Hospitals may be available with your employer or the Consulate General of Belgium at Mumbai.

In case you are from Bangalore, you can get the medical certificates from St.John’s Hospital at Hosur Road. This will cost Rs.3000 per person for 2 certificates and Rs.2500 for one certificate.

The Marriage certificate will be issued by the Registrar of Marriage at your locality/City.

Lastly and importantly make sure you have birth certificate of you and your dependant’s as some communes in Brussels will ask for it.

What do you do with these documents before submitting your visa application:
Get all your certificates except medical certificate legalized by the state government and the Ministry of External Affairs, Government of India.

Then submit these documents with visa application form to the VFS (this is the private company that has tie up with Belgium consulate for visa processing). You can check for more information on http://www.vfs-be-in.com/documents-bombay.aspx

Note:After you arrive at Brussels, you need to go to your respective muncipal hall (called as commune as in French and Gemeente in Dutch) and register within 8 days of your arrival. A commune here means a town hall which is similar to the corporation offices at Bangalore.

Some communes might ask for translation of your marriage certificate from English to French. That should be a sworn translation which is an official document that should be notarized and submitted to commune. Translation and notarization can be done at the Palais de Justice, Louise. This is the court of Belgium. The translation would cost you 65-80€. The notarization is free of cost.

Once you appear before the commune and produce all your legalized documents, you will be given an appointment; the date and time at which the police will come to your house for verification. The you will receive your white card in about 2 months(may take more time also).

In case you have your residence card also you need to follow the same procedure as your dependants have to be registered at the town hall.

  2. So Does this mean that a dependent can travel along with the work permit holder?

    Or work permit holder needs to reach first at Belgium and then dependent visa process starts? If so, how much time does it take to get dependent VISA for the spouse and child of Work permit B holder?

  3. @Jay, yes; the dependents of work permit holder can travel along with the work permit holder provided their visas are stamped. Visa application for work permit holder + dependents can be submitted at once. The visa issued (since Oct 2011) will be valid for one year. Therefore its your choice to get ur dependents when the visa is valid.
    If you were to process your dependents visa after u arrive in Belgium, it will take atleast 1-3 months for you to send the necessary papers for their visa application. The visa processing itself after submitting the application can take upto 3 months depending on the length of your stay in Belgium.
    Honestly speaking, I think it is good to process visa of work permit holder and his dependents at once. There will be no hassles.

  8. I am already have a Marriage Certificate issued the local authority. Please let me know if I will be able to apply for a dependent visa with this document. Do I need to get it legalized with a notary, govt officer etc. Please help, bit urgent. Thank you

    My husband is working at brussels and Im on a dependent visa in belgium.

    Currently we are at brussels for an onsite tenure from an indian company.We had got our visas through the indian company.

    As my husband has got a new job at brussels,he has filed his resignation and we have to travel back to india to serve the notice period.
    He has to submit his resident card with the indian employer and he has to get a new visa through the work permit from new belgium employer.

    I have my resident card and my visa is valid upto Nov 11 2014.My problem is if my husband returns back his resident card and if his file gets closed then,what will happen to my resident card,will my file also be closed or can i travel back with the same resident card?

    Another case is that,there is a possibility that i may also have to submit my resident card to the indian employer.In that situation can i travel back with my visa which is
    valid upto nov 11 2014 and apply for a new resident card?

    Any advice on my situation will be helpful.Thanks!

    1. Go to commune and get your work permit transferred from current employer to new one. In any case you never need to surrender your residence card, companies take it to facilitate the deregistration process.

    1. A spouse on dependant visa can work provided the prospective employer applies for the work permit. Alternatively a professional card can be applied by the individual. I have no personal experience on professional card. For more details check with the Belgian consulate or www.belgium.be

    Nice Article!

    I have a question that deviates from the topic you have posted, but in case you (or anybody reading this) have any information then I request you to please help me out.

    My wife who joined me here in Belgium as dependent has now got a job and also got her work permit processed from her employer. The problem is, it is valid only till the end of her RP (which is end of May this year). Unless my WP is extended, her WP will also not get extended, because officially she is still my dependent.
    Is there a way to cut off 'dependency' link, so that her employee can freely extend her WP even if my WP does not get extended.

    1. Hello Sujay,

      It really depends on how the employer files the application for work permit. When I arrived in Belgium the first time and when my work permit was processed, the validity was not dependent on my residence permit. So my RP and WP got renewed separately. Its dealt on a case by case basis. Perhaps the employer can be approached to get the work permit for one whole year and then the spouse can go to commune and change the RP based on their WP validity. Note that the rules change each year in September and I dont have any latest updates. In Belgium every case is dealt on an individual basis and to the knowledge of the dealing officer. So its hard to say something decisively.Although a general comment can be made it may not necessarily be the same in your case.

  16. Please dont ask questions like how long it will take for my dependant visa or how much time will it take exactly to get apostille. I am not someone who decides that and please understand that its left to the discretion of the dealing officer. Mind you that rules change each year and the blog is not updated each year. Kindly refer to the relevant sites(vfs, belgium.be etc) for any updated information. These sites also tell you how much time it can take in normal situations.

  17. I am in Belgium as dependent spouse of my husband who is here with work permit. Now I am getting a job opportunity in Netherlands.It is feasible to get Netherland work permit sitting in Belgium when I am on dependent visa? If I get the work permit for Netherlands, can I stay in Belgium and travel daily to Netherlands daily for work? How does RP works in that case?

    1. Yes, Mr/Ms Anonymous. Its possible but you will have to register in Netherlands and most likely de-register in Belgium upon having registered in NL.

    My husband has got Belgium WP type B and I am going on his dependent. I have got my VISA only for 6 months validity and it needs to be extended. My doubt is would I need to have all the things - PCC, marriage certificate, birth certificate again re-issued at the time of extension?

    1. Hi Akanksha,

      Congratulations on your visa.

      Normally the visa issued to dependents depends on the spouse/work permit holder's work permit/residence permit validity. These days its multiple entry and valid up to one year (if applied together). Well again its case by case basis and left to the discretion of the Officer.

      Once you are in Belgium and registered at the city hall (called as gemeente in Dutch or commune in French) then the residence permit is issued again based on the validity of your husband's work permit. For Renewal if you are in Belgium, these documents submitted at the time of visa are not necessary in most Communes although it may vary each year and based on commune. Your commune will advise you of required documents one month before the expiry of your existing valid residence permit.

    I have a question regarding the documents needed for a Belgium dependent VISA, hope you have answers for me and they might help others who stumble upon this blog searching for details on Belgium dependent VISA like me -
    We got married in 2008 and our marriage is registered immediately after our marriage ( 2009 ), so now my marriage certificate is almost 7 years Old. Do I need to get a new ( Duplicate ) marriage certificate with current issue date and get it legalized or will the old one enough for legalization.

    As a dependent you are not allowed to work in Belgium. Your visa allows you to stay in Belgium and travel across schengen nations. Only a few companies in Belgium are authorised to hire non european nationals as employees. Therefore the opportunities are limited. If you can find such an opportunity then they will process your work permit separately. Good Luck!
